Right To Buy
You have the right to buy if the Association bought your house as part of a stock transfer from Scottish Homes or North Ayrshire Council, and if you were the tenant at the time. You will retain this right for as long as you live in your present home. For other tenants with a Scottish Secure Tenancy Agreement there is a 10 year exemption period. This means you cannot apply to buy your home until after 30 September 2012 must have been resident in the property for 5 years.
If you occupy a property that was built after 30 September 2002 you do have the right to buy but must be resident in the property for 5 years before making an application to purchase the property. There is no 10 year exemption in these circumstances.
If you transfer to alternative accommodation your right to buy will be based on your current circumstances and you will not transfer any rights from a previous property. This means that if you have a retained right to buy and transfer to another Association property you will only be entitled to the right to buy at the new terms i.e. only after 30 September 2012 or after you have lived in your new property for 5 years if it was built after 30 September 2002.
An exemption to the right to buy may be applied for if you reside in a home which has special features for the elderly or has been adapted for particular needs. If you require any further information contact your local Area Team
If you have the right to buy and you wish to submit an application to purchase the Association will refer you to our agents, MMBL Ltd., who will visit your home and explain the right to buy process in full. In order to submit an application to purchase you must have a clear rent and council tax account. Once an application to has been submitted you will only be entitled to repairs which keep your property wind and watertight.
