Tenancy Agreement – Your Responsibilities
As a tenant you are agreeing to:
- Pay your rent four weekly in advance
- Look after your garden and common areas including the bin areas
- Keep the property in a good clean, tidy condition and proper decorative order
- Not allow anyone within your household or visiting your property act in an anti-social manner
- Notify the Association if there is any change in your household
- Notify the Association if you are leaving your property for more than 4 weeks.
- Allow a pre-termination inspection to be carried out and provide a forwarding address.
- Occupy the property as your principal home
- Request permission to make any alterations/improvements to the property
- Request to transfer/assign your tenancy to someone else.
- Request permission to sub let your property or keep a lodger.

Terminating your Tenancy
The only other way the Association can end your Scottish Secure Tenancy Agreement is if you breach a condition of the Tenancy Agreement and the Association proceeds with Court Action and a Decree for Eviction is granted by the Sheriff Court. The most common breaches of the Tenancy Agreement are:
- Failure to pay your rent and keep your account four weeks in advance
- Anti-Social Behaviour
- Condition of the property/garden
- Failure to occupy the property as your principal home
The Association does not proceed with Court Action without having contacted you and advised you of the breach of tenancy. If you are given this advice you should contact us immediately.

Tenants Handbook
All new tenants are issued with a Tenant Handbook which gives an easy reference for the services available from CHA and their partners.
Transfer/Mutual Exchanges
If you are already a CHA tenant you can apply for a transfer if you meet the following criteria:
- You are overcrowded
- You are under occupying your current property
- You have a medical condition which could be alleviated by alternative housing.
Your application will be pointed within 21 working days of receipt and you will be advised if you meet the criteria for a transfer. If you meet the criteria you will be placed on the transfer list and a home visit will be carried out.
You can submit an application to mutual exchange if you find a suitable partner who is a tenant of a social landlord or a registered housing association. Your application will be processed within 28 days and you will be kept updated on how the application is progressing throughout the process. If the mutual exchange is agreed a date of entry is set and you will sign your Tenancy Agreement with the appropriate landlord and arrange to move with the other party. The Association does not become involved in the exchanging of keys and you agree to accept the property in the condition at the time of exchange.
